Adoption of the East Riding Local Plan Update 2020-2039 and East Riding Design Code SPD
Important updates on the East Riding Local Plan Update 2020-2039 and the East Riding Design Code Supplementary Planning Document (SPD).
On 2 April 2025 East Riding of Yorkshire Council adopted the East Riding Local Plan Update 2020-2039. The adopted Local Plan Update now forms part of the Development Plan for the East Riding of Yorkshire and provides the basis for determining planning applications in the area, replacing the previous East Riding Local Plan adopted in 2016.
Inserted below is the Local Plan Update Adoption Statement, which sets out further information on the documents made available and where they can be viewed, in accordance with The Town and Country Planning (Local Planning) (England) Regulations 2012. A downloadable version of the statement is available, alongside the Local Plan Update documents and evidence base, on the Council's website.
Alongside the Local Plan Update, the East Riding Design Code Supplementary Planning Document (SPD) was also adopted by the Council on 2 April 2025. More information on the adoption of the Design Code SPD can be found below.
Notice of adoption of the East Riding Local Plan Update 2020-2039
The Town and Country Planning (Local Planning) (England) Regulations 2012 (as amended) (Regulations 17, 26 and 35)
In accordance with Regulation 17, 26 and 35 of the Town and Country Planning (Local Planning) (England) Regulations 2012 (as amended), this Adoption Statement hereby gives notice that on 2 April 2025 East Riding of Yorkshire Council adopted the East Riding Local Plan Update as a development plan document.
The East Riding Local Plan Update sets out the vision and planning policies for the area up to 2039 and is a key driver in determining planning applications and development opportunities. The Plan was the subject of an independent examination conducted by Katie Child B.Sc (Hons) MA MRTPI, an Inspector appointed by the Secretary of State. In her report received on 30 December 2024 the Inspector confirmed that, subject to a number of main modifications, the Plan was sound and capable of adoption. The recommended main modifications, along with the consequential minor modifications, have been included in the adopted East Riding Local Plan Update documents, which now carry full weight in the consideration of planning applications and replace the East Riding Local Plan 2012-2029 (adopted 2016).
Any person aggrieved by the East Riding Local Plan Update may, with leave from the High Court, make an application to the High Court under Section 113 (3) of the Planning and Compulsory Purchase Act 2004 on the grounds that:
i. The East Riding Local Plan Update is not within the powers conferred by Part 2 of the Planning and Compulsory Purchase Act 2004; or
ii. A procedural requirement has not been complied with.
Any such application must be made to the High Court not later than 15 May 2025. This represents a period of six weeks for applications beginning with the day after the date on which the Local Plan Update was adopted.
In accordance with Regulations 26 and 35 of the 2012 Regulations the following documents have been made available:
i. the East Riding Local Plan Update 2020-2039;
ii. this Adoption Statement; and
iii. the Sustainability Appraisal, made up of:
a. Sustainability Appraisal Main Report and Appendices;
b. Sustainability Appraisal Non-Technical Summary, and
c. Sustainability Appraisal of Proposed Modifications.
All Local Plan Update documents and associated evidence base, including the documents listed at (i), (ii) and (iii) above, can be viewed on the Council’s website at: www.eastriding.gov.uk/localplanupdate.

East Riding Design Code Supplementary Planning Document (SPD)
Notice of Adoption
Following agreement from the Cabinet in February 2025, the East Riding Design Code Supplementary Document (SPD) has been adopted by East Riding of Yorkshire Council on 2 April 2025.
A design code is a set of simple design requirements that provide a specific guide for the development of a site or area, bringing together important planning considerations such as nature, heritage, movement and health and well-being. The SPD provides further guidance on the application of policies within the East Riding Local Plan Update 2020-2039. The Design Code SPD is now a validation requirement for new planning applications and is an important material consideration in their determination.

The statement provides further details on the documents that have been made available in line with Regulation 14 of The Town and Country Planning (Local Planning) (England) Regulations 2012, and where they can be viewed. Paper copies of the main Design Code SPD document and the Adoption Statement can be viewed at Beverley, Haltemprice, Bridlington, Driffield, and Goole libraries, in line with the Council's Statement of Community Involvement.
